Intergovernmental Organizations (IGOs) and International Non-Governmental Organizations (INGOs) face particular challenges in using existing second-level curative rights mechanisms (i.e. UDRP and URS). For IGOs, these include questions of sovereign immunity. For both IGOs and INGOs, the current mechanisms are also premised on the ownership of trademark rights in the mark in question (in this case, the IGO/INGO’s name and acronym). | |

ICANN has in place an accreditation program for registrars and has committed to create an accreditation program for providers of Privacy and Proxy (P&P) services to gTLD domain names registrants. Privacy services publish a domain registrant’s name but keep contact details private; proxy services do not make publicly available any actual registrant information. Previous ICANN community work (including the WHOIS Review Team and the GNSO’s WHOIS Studies) has shown a lack of standard practices and rules in this area while identifying a number of needs to be addressed, ranging from law enforcement and IP owners to legitimate users of P&P services. |

Contact information is usually submitted in local script(s) and language(s), which can make it difficult to contact a registrant, e.g. for law enforcement or intellectual property rights holders. On the other hand, translation and transliteration of gTLD contact information raises issues of cost, accuracy and effectiveness. |

The Inter-Registrar Transfer Policy Development Process (IRTP) provides a procedure for domain name holders to transfer their names from one ICANN-accredited registrar to another. Part D aims to help prevent fraudulent domain name transfers through recommendations on registrar Transfer Dispute Resolution Procedures (TDRP) and reporting requirements, information resources on disputed transfers and potential remedies, and monitoring. |

The GAC has advised the Board to ensure the protection of IGO names and acronyms at the top and second levels in successive communiques, stating that implementation of such protection is in the public interest given that IGOs, as created by governments under international law, are objectively different right holders. While the GNSO PDP recommendations included certain reservations at the top and second levels, they did not recommend reserving IGO acronyms either at the top or second levels; instead the GNSO recommended that protection for IGO acronyms be achieved by way of claims notices via the Trademark Clearinghouse. It should be noted that the GNSO PDP concerns all gTLDs while the GAC advice concerns only new gTLDs. | |

In 2012, in response to the recommendations of the first WHOIS Review Team, the Board adopted a two-prong approach that simultaneously directed ICANN to (1) implement improvements to the current WHOIS system based on the Action Plan that was based on the recommendations of the WHOIS Review Team, and (2) launch a new effort, achieved through the creation of the Expert Working Group (EWG), to focus on the purpose and provision of gTLD directory services, to serve as the foundation of a Board-initiated GNSO policy development process (PDP) |
